The Anti-Dumping Commission helps Australian industry by managing Australia’s anti-dumping and countervailing system. We investigate claims that dumped and subsidised imports have injured Australian industry. Dumping generally occurs when a company exports a product into Australia at a price that is lower than the price charged in the country of manufacture.
One way to think about anti-dumping measures is the international equivalent of domestic measures intended to combat predatory pricing. Guidance from the Australian Competition and Consumer Commission says that while it is usually okay to sell goods at a below-cost price, “it may be illegal if it is done for the purpose of eliminating or substantially damaging a competitor”.
In 2002, the United States and Chile put forward a proposal on “improving flexibility and member control in WTO dispute settlement,” 5 which aimed to address US concerns regarding AB rulings on anti-dumping that targeted zeroing, a US practice designed to inflate dumping margins, and more generally to create “some form of additional guidance to WTO adjudicative bodies.” 6 Whether.
